Hydrant permit Terms and Conditions

1. Introduction

1.1. This agreement outlines the terms and conditions that apply to the permit holder.

1.2. This bulk water permit provides the permit holder with permission to access water from a water filling station and/or a hydrant where normal access to the water supply system may not otherwise be available. Accessing water from the water supply system without a permit is illegal, breaches the Water Act 1989 and may result in legal action.

1.3. Yarra Valley Water reserves its right to change the terms and conditions of this agreement and if this occurs, permit holders will be notified in writing.

2. Definitions

2.1. This permit is known as a Commercial Hydrant Permit. This is defined as follows; a business and/or individual with a valid ABN and a vehicle that is engaged to draw water from the water supply system across our district e.g. to supply a residential customer, road works, dust suppression, concrete cutting/grinding, developer, borer, sewer/water construction etc.

2.2. Fill means where a water carrier accesses the supply networks within Yarra Valley Water’s district and draws water from that network.

2.3. Business Day means a weekday except a public holiday.

3. Our service commitments

3.1. Yarra Valley Water will provide,

  • 3.1.1 Training in the safe operation of water filling stations and hydrants (where required),
  • 3.1.2. Adequate system pressure at water filling stations for efficient filling,
  • 3.1.3. Safe vehicle access to water filling stations,
  • 3.1.4. Reinstatement of water filling stations within 3 business days of reported faults,
  • 3.1.5. Permit holders with 7 business days’ notice of planned maintenance on water filling stations. This may be in the form of signage on the water filling station or a notice posted on our website.

4. Vehicles

4.1. Permits will be issued for each vehicle required to access Yarra Valley Water’s supply network.

4.2. Log Sheets must be completed whenever water is taken from an asset connected to Yarra Valley Water’s supply network. This includes, but is not limited to, hydrants, plugs and filling stations.

  • 4.2.1. Log Sheets must be submitted to Yarra Valley Water online through our website online.yvw.com.au by the 7th day of January, April, July and October for the preceding quarter. If no water is drawn from the supply network, a Log Sheet must still be submitted notifying a nil return.

5. Billing cycle & charges

5.1. For detail of the current price, please visit our website at yvw.com.au/bulkwater or refer to your account.

5.2. Each vehicle will incur the following charges:

  • 5.2.1. An annual permit fee. This fee will increase from 1 July each year in accordance with CPI.
  • 5.2.2. A Water Usage Charge of the current Non Residential price per kilolitre of the reported volume of water taken each month. This charge will increase from 1 July each year in accordance with Essential Services Commission pricing determination.
  • 5.2.3. A Non-Compliance fee per vehicle per quarter if Log Sheets are not submitted or are submitted after the due date.

5.3. As each permit is issued for a specific vehicle, YVW must be advised if a permit is no longer required. For example, where the vehicle may be sold or is no longer used for the permitted purpose. If the vehicle is replaced, YVW can arrange for the permit to be transferred to the new vehicle.

6. Under or overcharging

If you are overcharged you will receive a credit on your next account or a refund. If you have been undercharged, due to our error, we will only seek to recover amounts undercharged over the previous 12 months.

7. Paying your account

You are required to pay your bill by the due date. For a list of our payment options visit our website at yvw.com.au/pay or refer to your account.

8. Changes to this agreement

Yarra Valley Water reserves its right at any time in accordance with written advice to the Permit Holder;

  • (a) Vary the terms and conditions of this agreement or access to the water supply system,
  • (b) Increase or otherwise vary its charges, and
  • (c) Revoke or vary any permit.

9. Your responsibilities

1. You are required to:

  • 9.1. Ensure that each vehicle used to access water from hydrants is fitted with an approved backflow prevention device as referenced under the Australian Standard AS3500.
  • 9.2. Ensure that each backflow prevention device is tested by an accredited backflow plumber and the report(s) submitted to Yarra Valley Water upon application to ensure compliance.
  • Please Note: Annual testing is required for all testable devices.
  • 9.3. Ensure that each vehicle used to access water from hydrants or water filling stations has a valid Registered Water Carrier sticker attached to the rear of the tank.
  • 9.4. Ensure that you meet your legal obligations under the Victorian Food Act 1984 and you deliver water to your customers that is safe and suitable for its intended use. For more information, see the Environmental Health section of the Department of Health website (health.vic.gov.au). Without limiting this general obligation, a tanker used to cart drinking (potable) water for human consumption, food preparation or ice making must not be used to cart recycled or reclaimed water, toxic or hazardous chemicals, non-food liquids, and human or animal wastes.
  • 9.5. Ensure that relevant Occupational Health & Safety measures are taken when accessing hydrants and water filling stations including the wearing of safety clothing and complying with advised safety requirements as outlined on the WorkSafe Victoria website (worksafe.vic.gov.au).
  • 9.6. Ensure that approved 65mm fittings, fixtures and hoses are used on Hydrants and 80mm
    fittings, fixtures and hoses are used on Water Filling Stations at all times.
  • 9.7. Ensure that water filling stations and hydrants are operated correctly to minimise risk of damage to our assets & water supply system, the environment, and other parties in the vicinity of the water filling station or hydrant.
  • 9.8. Ensure that persons operating the water filling station or hydrant comply with any requirements outlined in material provided or signs displayed at the water filling station or hydrant.
  • 9.9. Ensure that any person operating a water filling station and/or hydrant under this permit has completed water filling station &/or fire hydrant training, carries their Yarra Valley Water approved training and/or induction card and complies with the terms and conditions of the Agreement.
  • 9.10. Pay bills in accordance with our payment terms.
  • 9.11. Notify us of any unauthorised water filling station and/or hydrant access by vehicles not
    displaying current permits, and
  • 9.12. Notify us of any damage to hydrants or water filling stations.

10. Water restrictions

Water Restrictions which apply to the use of drinking water supplied directly from Yarra Valley Water’s pipes and fittings also apply to the use of water taken under this permit.

11. Recycled water

Extraction and carting of Class A Recycled Water from any Recycled water hydrant or fire plug within Yarra Valley Waters’ service area is not permitted at any time.

12. Indemnity

You agree to indemnify Yarra Valley Water against any damages to its water mains or fittings and against any claims which may arise out of the grant of this permit.

13. Permit cancellation

The permit may be cancelled by either party with 14 days’ notice in writing. On cancellation of a permit all keys issued for operation of the water filling stations must be returned. We may also cancel a permit immediately, where you fail to comply with the terms and conditions of this agreement.

14. Privacy statement

Yarra Valley Water collects personal information for the purposes of providing water and related services and products, promoting such services and products and marketing research. We may disclose your personal information to our contractors for these purposes and other third parties including Melbourne Water and the Minister for Environment and Conservation relating to Parks Victoria services.
